CubeTunes Club Membership Agreement By clicking on the "Sign Up" button, you agree to accept the terms and conditions set forth in the CubeTunes Club Membership Agreement (“Agreement”), the Privacy Policy, the Security Statement, and the Usage Terms. CubeTunes Club Memberships Account Privileges Upon signing up to become a Member of the CubeTunes Club, Members are authorized to listen to music and download audio files via the functionality provided within the CubeTunes Club web site for their own personal use. Members are also allowed to view lyrics, song notes, and album art info and copy or download them for their own personal use. Members are allowed to download audio files as often as they like, provided that it does not disrupt CubeTunes Club's services or interfere with the security of the CubeTunes Club web site. Warranty CubeTunes Club makes no warranty on any content or files copied or downloaded from the web site and assumes no responsibility for any damages that they may cause Members. Member Responsibilities Members are solely responsible for any activity that occurs on their accounts. They are responsible for ensuring that their account password stays secure and is not disclosed to others. Members are encouraged to reset their passwords using the "Password Reset" feature provided on the CubeTunes Club web site should their passwords be compromised. Members may also contact CubeTunes Club for assistance using the "Contact Us" form. Unauthorized Use CubeTunes Club is not liable for any Member's losses that may be affiliated with the unauthorized use of his or her account. Members may be held liable for losses experienced by CubeTunes Club or other Members from the unauthorized use of their accounts. Account Termination Members may cancel their account by using the "Contact Us" form on the CubeTunes Club web site and submitting a message stating that they wish to have their account removed. Their username, email address, and password will be removed from CubeTunes Club Membership records. CubeTunes Club reserves the right to disable or terminate Member accounts at its sole discretion without prior notice. This includes, but is not limited to, any Member action or behavior that CubeTunes Club deems a violation of the Agreement or the Usage Terms. Members' Account Information & Security As per the Privacy Policy, your personal information will never be shared with anyone outside of Flying Cube, LLC. Personal information means only information required for Membership Registration: username, email address, and password. Email addresses will only be used for voluntary notices and any maintenance notifications. Passwords are stored in an encrypted format that does not allow CubeTunes Club to read them and unable to retrieve. Flying Cube, LLC accepts no liability for any damage to Members or CubeTunes Club caused by unauthorized access to personal information. Notifications Members of CubeTunes Club may voluntarily choose to receive notifications via email. Doing so authorizes CubeTunes Club to use email addresses provided by Members during the registration process for such notifications. Notifications are for sending emails to Members when new songs become available on CubeTunes Club, when feature updates are made to CubeTunes Club, and when the music of Rafe Lyford is performed. Members may cancel email notifications from CubeTunes Club by using the "Contact Us" form on the CubeTunes Club web site and submitting a message stating that they no longer wish to receive the notifications. CubeTunes Club may occasionally use Members' usernames and email addresses to promote other professional services and activities offered by Flying Cube, LLC. Members may opt out of such use of their personal information by using the “Contact Us” form on the CubeTunes Club web site and submitting a message stating that they do not want to receive information about professional services and activities offered by Flying Cube, LLC. Guest Book Policy The Guest Book provided on the CubeTunes Club web site is not to be used for providing confidential or sensitive information, with the exception of the information requested in order to post an entry. Hate speech on the Guest Book will not be tolerated and is not permitted. This includes statements that attack or humiliate an individual or group based on race or ethnic origin, religion, disability, gender, age, veteran status, and sexual orientation or gender identity. Harassment, impersonation, intimidation or bullying, encouraging violence, and disclosing other people's private information is also prohibited. CubeTunes Club and Flying Cube, LLC reserve the right to remove any Guest Book entry at any time without prior notice. Copyrights & Use of Content All music, lyrics, song notes, and album art (“Music Content”) on the CubeTunes Club web site is the property of Flying Cube, LLC or its affiliated content providers and are protected by copyright and other applicable laws. Music streams found on the CubeTunes Club web site log-in page are available to the public. With this exception, only CubeTunes Club Members may access the Music Content on the CubeTunes web site. The Music Content available on the CubeTunes Club web site is strictly for the personal, non-commercial use of CubeTunes Club Members. CubeTune Club Members may stream, download, or copy Music Content as often as they like under the condition that Members do not use Music Content for commercial purposes without the express prior written consent of Flying Cube, LLC. Commercial purposes are any public or non-personal uses, including but not limited to the following: selling, renting, broadcasting, distributing, or sub-licensing Music Content found on the CubeTunes Club web site to any third party. CubeTunes Club and Flying Cube, LLC reserve the right to terminate any Member that violates these rules at any time without prior notice. Flying Cube, LLC will pursue legal action against any Member that is found using the Music Content on CubeTunes Club for commercial purposes without the express prior written consent of Flying Cube, LLC. All content found on CubeTunes Club is the property of Flying Cube, LLC or its affiliated content providers and is protected by applicable laws.
